Welcome to Gami Creations. These Terms of Service govern your access to and use of www.gamicreations.com, including all purchases, products, digital content, custom services, communications, and other services provided through the website.

Throughout these Terms, “Gami Creations,” “we,” “us,” and “our” refer to Gami Creations. “Customer,” “you,” and “your” refer to any person who visits the website, submits information, places an order, or purchases a product or service.

By visiting our website, submitting personalization information, or placing an order, you agree to these Terms of Service, our Privacy Policy, Shipping Policy, and Return & Refund Policy. Please review these policies before completing a purchase.

2. Eligibility and Website Use

You must be legally capable of entering into a binding agreement in your place of residence to make a purchase from this website. When placing an order on behalf of a business, organization, or another person, you represent that you are authorized to do so.

You may not use the website, products, or services for an unlawful, fraudulent, abusive, deceptive, infringing, or unauthorized purpose.

You may not:

     
  • Attempt to gain unauthorized access to the website or another customer’s information.

  • Introduce viruses, malicious code, automated scraping systems, or other harmful technology.

  • Interfere with the security, operation, or availability of the website.

  • Use our website content, photographs, graphics, branding, or product designs without authorization.

  • Submit content that violates another person’s intellectual property, privacy, publicity, or other legal rights.

3. Product and Service Information

Gami Creations may offer physical products, personalized products, sublimated aluminum plaques, printed products, apparel, digital design files, custom artwork, personalized songs, and other creative products or services.

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, prices, production estimates, and availability. However, minor typographical errors, technical errors, or reasonable variations may occasionally occur.

Product photographs are provided for illustration. Screen settings, lighting, photography, image resolution, materials, printing methods, and the sublimation process may cause reasonable differences between an on-screen image or design proof and the finished product.

Frames, mounting hardware, stands, adhesives, display accessories, digital files, or other accessories are not included unless the applicable product page expressly states that they are included.

4. Personalized and Made-to-Order Products

Personalized products are created using information submitted or approved by the customer. This may include photographs, names, usernames, dates, messages, levels, colors, backgrounds, logos, artwork, and other customization details.

You are responsible for confirming that all submitted information is complete and correct, including:

     
  • Names and spelling.
    •  
  • Capitalization and punctuation.
    •  
  • Photographs and image quality.
    •  
  • Selected size, level, background, color, or style.
    •  
  • Messages, dates, usernames, and other text.
    •  
  • Shipping and contact information.

Orders may be delayed when required information is incomplete, photographs are unusable, messages are unanswered, or proof approval has not been received.

Changes requested after design work has started, after a proof has been approved, or after production has begun are not guaranteed. Additional work or replacement materials may require an additional charge.

5. Design Proofs and Approval

When a product includes a digital design proof, the proof is provided so the customer can review the layout, names, photographs, spelling, and other personalization details before production.

The customer is responsible for carefully reviewing the entire proof. Approval confirms that the design is accepted for production.

After approval, Gami Creations is not responsible for errors that were visible in the approved proof, including customer-submitted spelling mistakes, incorrect names, low-quality photographs, or incorrect selections.

Reasonable color differences between a digital proof and the finished product are not considered defects.

6. Customer-Submitted Content

By submitting photographs, names, logos, designs, messages, audio, stories, lyrics, artwork, or other materials, you represent that:

     
  • You own the content or have permission to use it.
    •  
  • You have permission from identifiable individuals when required.
    •  
  • The content does not infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights.
    •  
  • The content is not unlawful, threatening, hateful, defamatory, deceptive, or otherwise prohibited.

You grant Gami Creations a limited, non-exclusive license to access, copy, edit, format, print, reproduce, record, or otherwise use the submitted content only as reasonably necessary to prepare the design, manufacture the product, provide the requested service, communicate with you, fulfill the order, and provide customer support.

Submitting content does not transfer ownership of your original photographs or personal content to Gami Creations.

We may refuse or cancel an order involving content that appears unlawful, infringing, hateful, threatening, deceptive, sexually exploitative, or otherwise inappropriate.

7. Custom Music and Creative Services

When purchasing a personalized song, lyric, artwork, or other custom creative service, the product page will describe the deliverables, file format, included revisions, estimated completion time, and any usage rights provided with the purchase.

Customers are responsible for the accuracy and legality of stories, names, photographs, recordings, references, and other information submitted for a custom creative project.

Creative work is subjective. A customer’s personal preference regarding musical style, voice, arrangement, wording, colors, or artistic interpretation does not by itself mean the delivered work is defective when it substantially matches the description and information provided with the order.

Unless the product page expressly states otherwise, a custom song purchase does not transfer ownership of Gami Creations’ production methods, templates, underlying tools, reusable creative elements, branding, or general artistic processes.

8. Digital Products

Digital products may include design files, artwork, embroidery files, printable files, audio files, or other electronically delivered content. No physical item will be shipped when a product is clearly identified as a digital product.

Unless a product page expressly provides different license terms, purchasing a digital product grants the customer a limited, non-exclusive, non-transferable license for personal use or for creating finished physical products.

You may not:

     
  • Resell, share, give away, sublicense, or redistribute the original digital file.
    •  
  • Upload the original file to another marketplace, website, file-sharing platform, or digital library.
    •  
  • Claim the original design as your own.
    •  
  • Convert, trace, modify, or repackage the file for resale as another digital product.
    •  
  • Use the file in a way that violates third-party rights or applicable law.

The customer is responsible for confirming software, equipment, file-format, and production compatibility before purchase.

9. Orders and Order Acceptance

Submitting an order does not automatically guarantee acceptance. An order is subject to payment authorization, product availability, personalization review, and our ability to complete the requested work.

We may contact you for clarification or additional information before accepting or producing an order.

We may refuse or cancel an order because of:

     
  • Payment failure or suspected fraud.
    •  
  • Incorrect pricing or product information.
    •  
  • Unavailable materials.
    •  
  • Incomplete or unusable customer information.
    •  
  • Prohibited or infringing content.
    •  
  • Technical errors.
    •  
  • Our inability to reasonably complete the requested customization.

If we cancel a paid order before fulfillment, we will issue the applicable refund to the original payment method.

10. Prices, Taxes, and Payment

Prices are displayed in the currency shown on the website. Prices may change without notice, but a price change will not normally affect an order that has already been accepted and paid, except when correcting an obvious pricing or technical error.

Applicable taxes, shipping charges, discounts, and other charges are calculated and displayed before checkout is completed.

You agree to provide current, accurate, and complete billing and payment information. Payment must be successfully authorized before an order can enter production or be delivered.

11. Discounts and Promotions

Discount codes and promotions may be subject to expiration dates, product exclusions, order minimums, usage limits, and other stated conditions.

Unless expressly stated otherwise:

     
  • Discounts cannot be combined.

  • Discounts cannot be applied retroactively.
    •  
  • Discounts have no cash value.
    •  
  • Shipping charges and taxes may be excluded from the discount.

We may cancel or correct a promotion affected by fraud, misuse, technical errors, or inaccurate information.

12. Production and Shipping

Personalized physical products are made to order. Production estimates begin only after Gami Creations receives all required information and usable files and, when applicable, after the customer approves the design proof.

Available shipping options, charges, and estimated delivery times are displayed at checkout or described in our Shipping Policy.

Delivery estimates are not guaranteed delivery dates. Carrier delays, severe weather, holidays, incorrect addresses, service interruptions, customs processing, and other circumstances outside our reasonable control may affect delivery.

13. Shipping Addresses and Delivery

Customers are responsible for providing a complete and accurate shipping address. Contact us immediately if a correction is needed. Address changes are not guaranteed after an order has entered production or shipment.

Additional costs caused by an incorrect, incomplete, or outdated customer-provided address may be the customer’s responsibility where permitted by law.

When tracking marks a package as delivered but the customer cannot locate it, the customer should verify the address, check with household members and neighbors, and contact the carrier. Gami Creations will provide reasonable assistance but cannot guarantee recovery of a package confirmed as correctly delivered by the carrier.

14. Cancellations, Returns, and Refunds

Cancellation, return, replacement, and refund eligibility is governed by our Return & Refund Policy.

Because personalized products are created specifically for one customer and cannot normally be restocked or resold, they are generally final sale after design work or production begins.

This does not affect rights or remedies that cannot be excluded under applicable law. Qualifying damaged, incorrect, missing, or defective orders should be reported using the process and timeframe stated in our Return & Refund Policy.

15. Intellectual Property

The Gami Creations website and its original content—including branding, logos, text, photographs, graphics, page layouts, original artwork, product presentations, and original designs—are owned by or licensed to Gami Creations and are protected by applicable intellectual property laws.

No website content may be copied, reproduced, modified, republished, distributed, sold, or commercially exploited without written authorization, except as permitted by law or by an applicable digital product license.

Purchasing a physical product does not transfer ownership of the underlying design, template, branding, production file, or intellectual property.

16. Third-Party Names and Trademarks

Third-party names, logos, platform names, product names, characters, and trademarks remain the property of their respective owners.

Unless expressly stated otherwise, Gami Creations is not affiliated with, sponsored by, authorized by, or endorsed by TikTok, Meta, Facebook, Instagram, YouTube, Spotify, Apple, Amazon, or any other third-party company or platform referenced in a product or design.

Customers requesting the use of third-party material are responsible for confirming that they have any necessary permissions.

17. Reviews and Customer Feedback

Customers may provide honest feedback and reviews about their experience. We do not prohibit or penalize honest reviews.

By voluntarily submitting a review, testimonial, photograph, or public comment directly to Gami Creations, you grant us permission to display, reproduce, and share that submission for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.

We may decline to publish or may remove content containing private information, spam, threats, hate speech, unlawful material, or content unrelated to the product or service.

18. Third-Party Services and Links

The website may use or link to third-party services for hosting, payments, shipping, analytics, advertising, social media, product customization, or other functions.

Third-party services are governed by their own terms and privacy policies. Gami Creations is not responsible for the independent content, availability, security, or conduct of third-party websites or services, except to the extent required by law.

Our collection and use of personal information is described in our Privacy Policy.

Do not send payment card numbers, passwords, government identification numbers, medical information, or other unnecessary sensitive information through email, contact forms, personalization fields, or order notes.

20. Errors, Inaccuracies, and Omissions

Information on the website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, or other information.

We may correct errors, update information, or cancel an affected order when reasonably necessary. When a paid order is canceled, the applicable refund will be issued to the original payment method.

21. Service Availability

We may update, modify, suspend, or discontinue website features, products, or services when reasonably necessary. We do not guarantee that the website will always operate without interruption or technical errors.

Scheduled maintenance, hosting interruptions, security concerns, internet outages, or events outside our control may temporarily affect access.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and services are provided on an “as available” basis. We do not guarantee that every website feature will be uninterrupted, error-free, or compatible with every device or browser.

Products remain subject to any warranties, consumer protections, or remedies that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, Gami Creations will not be responsible for indirect, incidental, special, punitive, or consequential damages arising from use of the website, delayed delivery, third-party services, or misuse of a product.

Where liability cannot legally be excluded, any limitation applies only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

24. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable expenses resulting from your unlawful use of the website, your violation of these Terms, or your submission of content that infringes another person’s rights.

This provision does not apply to the extent a claim resulted from the negligence, unlawful conduct, or breach of Gami Creations.

Gami Creations is not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier disruptions, labor interruptions, power or internet outages, supply shortages, government actions, public emergencies, or failures of third-party services.

We will make reasonable efforts to communicate significant delays and provide legally required options.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

27. No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision later.

These Terms, together with the applicable product description, Privacy Policy, Shipping Policy, Return & Refund Policy, and any written terms expressly provided for a particular order, constitute the agreement between the customer and Gami Creations regarding the purchase and use of our products and services.

29. Governing Law

These Terms are governed by the applicable laws of the State of Oklahoma and the United States, without limiting any mandatory consumer rights that apply based on the customer’s location.

30. Changes to These Terms

We may update these Terms when our products, services, business practices, or legal obligations change. The current version will be posted on this page with an updated revision date.

Changes apply prospectively from the date they are published unless applicable law requires otherwise.
